(1) No post in the civil service shall be filled by any other means except as provided in this Act.
(2) In the case of civil servants working in ministries, secretariats, commissions and departments, and in the case of civil servants working in offices within the valley, in the case of civil servants in civil libraries and district offices, salaries should not be paid without passing the salary report from the relevant treasury and accounting controller office.
(3) If an employee is appointed contrary to sub-section (1), the amount of salary, allowance and other benefits received by such employee shall be collected from the appointing official and if the salary is paid without passing the salary report as per sub-section (2), the amount of salary, allowance and other benefits received by such employee shall be collected as government dues. But this sub-section shall not be deemed to have created any hindrance in the payment of salary to the employees who have been suspended. Explanation:- For the purpose of this sub-section, "dismissed employee" shall mean an employee who has not been matched in another organization or post due to termination of the organization's position.
